Communicated cases against Greece: N.A. and others

The case of N.A. and others v Greece (application no. 11216/20) concerns the living conditions of pregnant women at the time of lodging their applications with the Court. They lived either in tents in the forest outside the hotspot, or in a container inside the hotspot. Interim measures under Rule 39 were granted. The ECtHR asked whether the living conditions of these pregnant women, including those transferred to containers, were compatible with Article 3 and/or Article 8 ECHR. Moreover, the Court asked, in light of the interim measures, whether the State hindered the effective exercise of an applicant’s right of application, ensured by Article 34 ECHR, or whether there was an objective impediment that hindered such application. Finally, the Court asked whether one applicant had an effective remedy for her complaints regarding Article 3 ECHR, as required by Article 13 ECHR.
