European Parliament and the Council: Qualification Directive (recast) transposition deadline 21 December 2013

21 December 2013 is the deadline for the transposition of Directive 2011/95/EUon standards for the qualification of third-country nationals or stateless persons as beneficiaries of international protection, for a uniform status for refugees or for persons eligible for subsidiary protection, and for the content of the protection granted (recast). According to Article 39 of the recast Directive, Member States are required to bring into force the laws, regulations and administrative provisions necessary to comply with the recast Directive by this date. From this date onwards, the recast Directive is an enforceable part of national legal orders in Member States.

The recast Directive was adopted in December 2011 and is binding on all EU Member States except for UK, Denmark and Ireland, who have opted out. However, the UK and Ireland remain bound by the previous 2004 Directive. The recast Directive constitutes an important step forward in harmonizing eligibility criteria and the content of protection at EU level. It improves the minimum standards laid out in the 2004 Directive in a number of key areas, including a greater recognition of the gender related aspects of applications for international protection and the best interests of the child.
