Italy: Well-founded risk of inhuman treatment in case of return to Nigeria

On 10 January 2020, the Tribunal of Genoa granted subsidiary protection to a Nigerian woman, on the grounds that she would face a risk of inhuman treatment upon return due to unavailability of protection by the national authorities.

The applicant, a woman from Nigeria, reported that she was born in the Delta State in a very poor family and that she was forced by her father to marry a man who had often abused her. She was helped to escape by a woman who brought her to Libya under false pretenses where she was forced to prostitute herself.

The Court found that although the applicant was not cooperative during the interview, her story was coherent and her behavior during the hearing displayed evidence of the trauma she was still experiencing. It considered that in case of return to Nigeria, she would face serious forms of violence due to the lack of protection by the national authorities and granted the applicant subsidiary protection on the basis of the well-founded risk of inhuman treatment in case of return.
