Germany: Social Court of Berlin and Brandenburg rules that asylum applicant has right to receive vocational training, despite low recognition rate

On 24 January 2018, the Social Court of Berlin and Brandenburg ruled in an appeal brought by an asylum applicant from Cameroon who had his request to receive vocational training rejected by the social authorities. The rejection was based on the lack of a prospect of “legal and permanent residence” since the recognition rate of asylum applications lodged by Cameroonian nationals in Germany was considered very low. According to the Social Court of Berlin and Brandenburg, the lack of clarity regarding the prospects of the applicant’s stay in Germany must be weighed in his favour. Moreover, the prospects of his stay cannot be assessed solely based on the recognition rate of applications brought by Cameroonian nationals, but on a case-by-case basis. Therefore, the Social Court ruled that the applicant is entitled to the vocational training he had requested.
