Communicated cases against Greece (Application Nos. 12237/20 and 12736/20) and Ukraine (Application No. 29662/13)

  • L.A. and Others and A.A. v Greece (Application Nos. 12237/20 and 12736/20): The case concerns a mother, her two children, and an unaccompanied minor, all of Syrian nationality. They allege that they were returned from Greece to Turkey and obstructed from lodging an asylum request. They complain that the conditions leading up to their return were contrary to Articles 3 and 5 ECHR. They also complain under Article 13 ECHR that there was no legal remedy available in respect of these complaints.
     
  • Shoygo v Ukraine (Application No. 29662/13): The case concerns the detention of a Russian national or stateless person in Ukraine. He alleges that his birth was never registered and that he has no formal identification documents. He was arrested in Ukraine after attempting to cross the border into Moldova. The Ukrainian authorities ordered he be detained for twelve months pending expulsion, while the Russian embassy claimed that it was not possible to determine his Russian citizenship. He complains that his detention pending expulsion was contrary to Article 5 (1), (4) and (5) ECHR.
